Overview

Legal framework of the employment relationship; employment status; sources, content, variation & termination of the contract of employment; discrimination & equal pay; general pay issues; unfair dismissal; business restructuring (including redundancies & transfers of undertakings); health & safety (especially stress at work); freedom of association & human rights.

Aims

The course unit aims to give students an understanding and awareness of the way in which the employment relationship is regulated and, in particular, the growing body of employment legislation. This will include an understanding of the influence of EU law on domestic legislation and the potential implications of ‘Brexit’. 

Learning outcomes

At the end of the course unit students should be able to:

  • Identify the legal issues in an employment-related scenario and advise organisations accordingly
  • Explain the legal principles relevant to such issues
  • Apply the legal principles to the facts of a given case
  • Identify the management implications in an employment-related legal scenario
  • Assess the likely impact of legislation on organisations/individuals

Assessment methods

1) Employment Tribunal Report (50%) - around 3000 words

2) 2 hours partly-revealed examination (50%) (2 questions from 6)
